The 4 Things You Can Do If Your Naturalization Application Was Denied

ImmigrationPolicy

If an immigrant’s naturalization application was denied, then there are four things that they can, and should, do. By doing these things, and speaking with a lawyer, they will be much closer to becoming a United States citizen.

 The Significance Of Naturalization

Someone who is born in the United States, to parents who are American citizens, will be an American citizen by virtue of their birth.

On the other hand, if someone is born in another country, and they enter the United States on a green card, then they can only become a United States citizen by going through the naturalization process.

The naturalization process allows a non-U.S. citizen to become a U.S. citizen. By doing so, they have all the same rights and privileges as U.S. citizens, except for being eligible for the presidency.

What Are The 4 Things You Can Do If Your Naturalization Application Was Denied?

1: Speak With A Lawyer

If an immigrant’s naturalization application has been denied, then they should speak with an immigration lawyer.

By speaking with an immigration lawyer, an immigrant will be able to go over why their naturalization application was denied. And, in doing so, they can figure out what they should do, to rectify that denial.

 2: Review The Denial Letter

Outside of speaking with a lawyer, an immigrant should also review the denial letter.

If the denial was due to a very particular, but significant, reason, such as an immigrant not having a favorable disposition towards the United States, then this must be addressed in the proper manner.

On the other hand, if the letter says that naturalization was denied due to missing – or false – information, among other possibilities, then these issues should be corrected.

 3: File An Appeal

If an immigrant was denied naturalization due to something that they believe to be false – not having a favorable disposition to the United States, for example – then the best thing to do is to file an appeal.

A good appeal can lead to the naturalization denial being reversed. But, this is only true, if the appeal is successful and it will only be successful if the appeal is carried out effectively.

To file an effective appeal, an immigrant must work with a lawyer. By  doing so, they can develop an appeal that works with the facts and, in doing so, leads to naturalization.

 4: Reapply For Naturalization

Many naturalization denial letters arise from minor errors.

Just as an example, if an immigrant misspelled their name, and this is what led to their denial, then that minor error should be rectified.

By rectifying that error, and sending in a new application that reapplies for naturalization, an immigrant should be able to become a United States citizen.

The same basic principle applies to any other minor, and easily fixed, errors.
