Getting An EB-2 NIW As A Filmmaker

A filmmaker who meets the rules, requirements, and regulations that govern the EB-2 NIW can live and work in the United States without traditional labor certification.

What Is The EB-2 NIW? 

The EB-2 is a visa that allows those with either an advanced degree or exceptional ability to live and work in the United States.

A National Interest Waiver – or “NIW,” for short – is a waiver that allows someone to live and work in the United States without a job offer or labor certification.

Many filmmakers choose to pursue an EB-2 NIW because, with such an arrangement, they can pursue their own film projects without being bound to another organization.

How Can A Filmmaker Obtain An EB-2 NIW? 

A filmmaker who wishes to obtain an EB-2 NIW must develop a proposal. This proposal must outline a film-related project that they wish to bring to fruition.

On its own, though, this proposal is not enough; the project that has been proposed must benefit the United States and, in doing so, make it a matter of national importance that an EB-2 NIW is granted.

None of this is easy. But, it can be done with much greater ease, if a filmmaker works with an experienced immigration lawyer.

Outside of what has been clarified, a filmmaker must also prove that they have an exceptional ability within their field. And, some of the ways that a filmmaker can, and should, do this are as follows:

  • Present reviews and other, related, documentation that demonstrates the acclaim their work has received.
  • Show that they have achieved commercial success as a filmmaker.
  • Demonstrate that they have commanded a high salary, or some other form of remuneration. for their work.
  • Present nationally and internationally recognized awards, related to their success as a filmmaker.
  • Go over documentation that shows they have worked as a filmmaker for at least ten years.
