Getting A Green Card Through A Physician National Interest Waiver
If an immigrant possesses an exceptional ability, or happens to hold an advanced degree, then they may be able to obtain an EB-2 visa, coupled with a National Interest Waiver.
Going over what an immigrant can do, to obtain an EB-2 coupled with a physician NIW, and speaking with an immigration lawyer, makes it much easier to live and work in the United States.
What Is The EB-2 NIW Visa For Physicians?
The EB-2 visa is a visa that belongs to the second-preference employment category of U.S. immigrant visas.
Someone who obtains an EB-2 visa is, as per the requirements of the visa, in possession of either an exceptional ability or an advanced degree.
Just as an example, if an immigrant happens to be a physician, and they have an advanced degree to support this, then they may be able to obtain an EB-2 visa and an NIW.
On the other hand, if this same immigrant also has an exceptional ability, and evidence that supports this exceptional ability, then they may have an even easier time obtaining an EB-2 visa and an NIW.
If an immigrant obtains an EB-2 then, on its own, they must generally work for a U.S. employer. But, if that same immigrant obtains an EB-2 visa, with an NIW, then there is no need for them to get a labor certification.
A National Interest Waiver – or “NIW,” for short – allows an immigrant to live, and work, in the United States without labor certification or, in turn, a conventional job.
The act of obtaining an NIW, coupled with an EB-2 visa, allows a physician to live, and work, in the United States without needing a conventional job offer/employment situation.
If a physician wishes to live and work in the United States on an EB-2 NIW, though, they must work in a manner that supports the public interest of the United States
How Can A Physician Get An EB-2 Visa With A National Interest Waiver?
A physician can obtain an EB-2 visa, with an NIW, if they satisfy the requirements of this visa. And, with that in mind, these requirements are as follows:
- You must work full-time, in a clinical practice, and have done so for at least five years..
- You must work in primary care – if you are a general practitioner, for example, then this counts – or be a specialty physician.
- You must serve in a Health Professional Shortage Area, Mental Health Professional Area, a Medically Underserved Area, Veterans Affairs facility or, if you’re a specialist, or in Physician Scarcity Area.
- You must obtain a statement from either a federal agency, or a state health department, that is familiar with your qualifications and states that your work is in the public interest.
